　　中国共产党党内法规制定条例 第一条 为了规范中国共产党党内法规制定工作，建立健全党内法规制度体系，提高党的建设科学化水平，根据《中国共产党章程》，制定本条例。

　 第二条 党内法规是党的中央组织以及中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的规范党组织的工作、活动和党员行为的党内规章制度的总称。

　 党章是最根本的党内法规，是制定其他党内法规的基础和依据。

　 第三条 党的中央组织制定的党内法规称为中央党内法规。下列事项应当由中央党内法规规定：

　 (一)党的性质和宗旨、路线和纲领、指导思想和奋斗目标;

　 (二)党的各级组织的产生、组成和职权;

　 (三)党员义务和权利方面的基本制度;

　 (四)党的各方面工作的基本制度;

　 (五)涉及党的重大问题的事项;

　 (六)其他应当由中央党内法规规定的事项。

　 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委就其职权范围内有关事项制定党内法规。

　 第四条 党内法规的名称为党章、准则、条例、规则、规定、办法、细则。

　 党章对党的性质和宗旨、路线和纲领、指导思想和奋斗目标、组织原则和组织机构、党员义务和权利以及党的纪律等作出根本规定。

　 准则对全党政治生活、组织生活和全体党员行为作出基本规定。

　 条例对党的某一领域重要关系或者某一方面重要工作作出全面规定。

　 规则、规定、办法、细则对党的某一方面重要工作或者事项作出具体规定。

　 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的党内法规，称为规则、规定、办法、细则。

　 第七条 制定党内法规应当遵循下列原则：

　 (四)符合科学执政、民主执政、依法执政的要求;

　 (五)有利于推进党的建设制度化、规范化、程序化;

　 (六)坚持民主集中制，充分发扬党内民主，维护党的集中统一;

　 (七)维护党内法规制度体系的统一性和权威性;

　 (八)注重简明实用，防止繁琐重复。

　 第八条 制定党内法规应当统筹进行，科学编制党内法规制定工作五年规划和年度计划，突出重点、整体推进，逐步构建内容协调、程序严密、配套完备、有效管用的党内法规制度体系。

　 第九条 中央党内法规制定工作五年规划，由中央办公厅对中央纪律检查委员会、中央各部门和省、自治区、直辖市党委提出的制定建议进行汇总，并广泛征求意见后拟订，经中央书记处办公会议讨论，报中央审定。

　 中央党内法规制定工作年度计划，由中央办公厅对中央纪律检查委员会、中央各部门每年年底前提出的下一年度制定建议进行汇总后拟订，报中央审批。

　 第十条 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委提出的中央党内法规制定建议，应当包括党内法规名称、制定必要性、报送时间、起草单位等。

　 第十一条 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委可以根据职权和实际需要，编制本系统、本地区党内法规制定工作规划和计划。

　 第十二条 党内法规制定工作规划和计划在执行过程中，可以根据实际情况进行调整。

　 第十三条 中央党内法规按其内容一般由中央纪律检查委员会、中央各部门起草，综合性党内法规由中央办公厅协调中央纪律检查委员会、中央有关部门起草或者成立专门起草小组起草。

　 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的党内法规，由其自行组织起草。

　 第十四条 党内法规草案一般应当包括下列内容：

　 (二)制定目的和依据;

　 (三)适用范围;

　 (四)具体规范;

　 (五)解释机关;

　 (六)施行日期。

　 第十五条 党内法规应当方向正确，内容明确，逻辑严密，表述准确、规范、简洁，具有可操作性。

　 第十六条 起草党内法规，应当深入调查研究，全面掌握实际情况，认真总结历史经验和新的实践经验，充分了解各级党组织和广大党员的意见和建议。必要时，调查研究可以吸收相关专家学者参加或者委托专门机构开展。

　 第十七条 起草党内法规的部门和单位，应当就涉及其他部门和单位工作范围的事项，同有关部门和单位协商一致。经协商未能取得一致意见的，应当在报送党内法规草案时对有关情况作出说明。

　 第十八条 起草党内法规，应当与现行党内法规相衔接。对同一事项，如果需要作出与现行党内法规不一致的规定，应当在草案中作出废止或者如何适用现行党内法规的规定，并在报送草案时说明情况和理由。

　 第十九条 党内法规草案形成后，应当广泛征求意见。征求意见范围根据党内法规草案的具体内容确定，必要时在全党范围内征求意见。征求意见时应当注意听取党代表大会代表和有关专家学者的意见。与群众切身利益密切相关的党内法规草案，应当充分听取群众意见。

　 征求意见可以采取书面形式，也可以采取座谈会、论证会、网上征询等形式。

　 第二十条 起草部门和单位向审议批准机关报送党内法规草案，应当同时报送草案制定说明。制定说明应当包括制定党内法规的必要性、主要内容、征求意见情况、同有关部门和单位协商情况等。

　 第二十一条 审议批准机关收到党内法规草案后，交由所属负责法规工作的机构进行审核。主要审核以下内容：

　 (一)是否同党章和党的理论、路线、方针、政策相抵触;

　 (二)是否同宪法和法律不一致;

　 (三)是否同上位党内法规相抵触;

　 (四)是否与其他同位党内法规对同一事项的规定相冲突;

　 (五)是否就涉及的重大政策措施与相关部门和单位协商;

　 (六)是否符合制定权限和程序。

　 对存在问题的党内法规草案，审核机构经批准可以向起草部门和单位提出修改意见。如起草部门和单位不采纳修改意见，审核机构可以向审议批准机关提出修改、缓办或者退回的建议。

　 第二十二条 党内法规的审议批准，按照下列职权进行：

　 (一)涉及党的中央组织、中央纪律检查委员会产生、组成和职权的党内法规，以及涉及党的重大问题的党内法规，由党的全国代表大会审议批准;

　 (二)涉及党的地方组织和基层组织产生、组成和职权的党内法规，涉及党员义务和权利方面基本制度的党内法规，以及涉及党的各方面工作基本制度的党内法规，由党的中央委员会全体会议、中央政治局会议或者中央政治局常务委员会会议审议批准;

　 (三)应当由中央发布的其他党内法规，根据情况由中央政治局常务委员会会议审议批准，或者按规定程序报送批准;

　 (四)中央纪律检查委员会、中央各部门发布的党内法规，由中央纪律检查委员会、中央各部门审议批准;

　 第二十三条 经审议批准的党内法规草案，由负责法规工作的机构核文后按规定程序报请发布。

　 党内法规经批准后一般应当公开发布。

　 第二十五条 党章在党内法规中具有最高效力，其他任何党内法规都不得同党章相抵触。

　 中央党内法规的效力高于中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的党内法规的效力。

　 省、自治区、直辖市党委制定的党内法规不得同中央纪律检查委员会、中央各部门制定的党内法规相抵触。

　 第二十六条 同一机关制定的党内法规，一般规定与特别规定不一致的，适用特别规定;旧的规定与新的规定不一致的，适用新的规定。

　 第二十七条 中央纪律检查委员会、中央各部门制定的党内法规对同一事项的规定不一致的，提请中央处理。

　 第二十八条 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委发布的党内法规有下列情形之一的，由中央责令改正或者予以撤销：

　 (一)同党章和党的理论、路线、方针、政策相抵触的;

　 (二)同宪法和法律不一致的;

　 (三)同中央党内法规相抵触的。

　 第二十九条 中央党内法规解释工作，由其规定的解释机关负责。本条例施行前发布的中央党内法规，未明确规定解释机关的，由中央办公厅请示中央后承办。

　 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的党内法规由其自行解释。

　 党内法规的解释同党内法规具有同等效力。

　 第三十条 中央纪律检查委员会、中央各部门和省、自治区、直辖市党委制定的党内法规应当自发布之日起30日内报送中央备案，备案工作由中央办公厅承办。具体备案办法由中央办公厅另行规定。

　 第三十一条 党内法规制定机关应当适时对党内法规进行清理，并根据清理情况及时对相关党内法规作出修改、废止等相应处理。

　 第三十二条 党内法规制定机关、起草部门和单位可以根据职权对党内法规执行情况、实施效果开展评估。

　 第三十三条 党内法规的修改、废止，适用本条例。

　 党章的修改适用党章的规定。

　 第三十四条 中央军事委员会及其总政治部依照本条例的基本精神制定军队党内法规。
